What is BAC?

Blood alcohol concentration level, or BAC, is a number typically expressed in a percentage that references the concentration of alcohol within the blood stream. California’s DUI law prohibits a person from driving when they have a concentration of .08 percent or more alcohol in their blood system (.04% or more if you drive commercial vehicles or .01% or more if under 21). State of California has strict drunk driving laws for drivers under the age of 21 and repeat offenders (.01%), and a "no tolerance" law for drivers under the age of 18

I’ve been arrested, what happens now?

After being arrested, a Court Hearing will be scheduled. At your hearing you have a right to have an attorney and he or she will help make decisions on how to proceed based on your particular circumstances. In some cases your attorney will be able to have the charges reduced or possibly dismissed. In other cases it may be necessary to schedule a trial. Every case is unique, so hiring an experienced attorney can help you make the best decisions for your case and your future.

Why do I need to contact the DMV after my arrest?

The DMV & Court are 2 separate proceedings. It is important that you take immediate action and contact the California DMV to inform them of your DUI. If you fail to contact the DMV and schedule a hearing within 10 days of being arrested, your license will automatically be suspended in most cases.

How much will this cost me?

There are many potential costs involved with a DUI. Fines, Court costs, DUI schools, and attorney fees will vary depending on the severity of your case. Your insurance premium will also most likely increase. At the Law Offices of Michael L. Kellogg, we charge a flat fee. Your Initial consultation is free so you will know exactly what your financial commitment will be before retaining our services.
